Terms of sale
1.2. These General Conditions have been drawn up in accordance with the provisions of Law 34/2002, on Services of the Information Society and Electronic Commerce, Law 7/1998 on General Contracting Conditions, Royal Decree 1906/1999 regulating telephone or electronic contracting with general conditions in development of article 5.3 of Law 7/1998, Law 26/1984 General for the Defence of Consumers and Users, Law 7/1996 on the Regulation of Minority Trade, Royal Decree Law 14/1999 regulating Electronic Signature and any legal provisions that may apply.
1.3. The use and/or acquisition of any of the products of the online booking platform implies the acceptance as a user, without reservations of any kind, of each and every one of the General Contracting Conditions, of the General Conditions of Use of the Portal as well as, if applicable, of the Particular Conditions that, if applicable, govern the acquisition.
1.4. Andrea ’s diving (Erika Lopez SLU) informs that the procedures to carry out the acquisition of goods are those described in these general conditions, as well as those other specific that are indicated on the screen during navigation, so that the user declares to know and accept these procedures as necessary to access the products and services offered on the Portal.
1.5. Any modification and / or correction of the data provided by users during navigation must be carried out according to the indications included in the PORTAL.
2. PRODUCTS OFFERED. PURCHASE SYSTEM
2.1. The products offered on the online booking platform, as well as their characteristics and sales prices, will be announced in this. The prices indicated include VAT, although they will be subject to the taxes that apply to them if applicable, according to the information provided by the user and will be at all times the current prices, except typographical error. Andrea ss *diving (Erika *Lopez SLU) reserves the right to modify without prior notice the products contained and offered through the online booking platform. In this way, Andrea ’s diving (Erika Lopez SLU) may at any time add new products to those included in the online booking platform, understanding, unless otherwise provided, that such new products will be governed by the provisions of the General Conditions in force at that time. Likewise Andrea ’s *diving (Erika *Lopez SLU) reserves the right to stop providing access, at any time and without prior notice, to any of the products offered on the online booking platform.
2.2. For the acquisition of products on the online booking platform, Andrea ’s diving will request users to proceed to register, for which these users, who must be over eighteen, must fill in the instructions that appear on the screen.
2.3. Once the user has registered, and to proceed with the purchase on the online booking platform, he must add the product he wishes to acquire in the "shopping basket", according to the indications contained in the online booking platform itself, filling in the order form provided for this purpose and sending it to Andrea -s *diving (Erika *Lopez SLU), which implies the irrevocable reading and acceptance of each and every one of these General Conditions, as well as, if applicable, the existing Particular Conditions.
2.4. Once the purchase has been made and in the shortest possible time, Andrea ’s diving (Erika Lopez SLU) will send the user by email a proof of purchase. Likewise, the Customer may request Andrea ’s diving (Erika Lopez SLU) the corresponding invoice, which will be sent by post to the address provided. The order confirmation and the receipt of purchase will not be valid as an invoice. The purchase prices will be those in force at the time the order is placed.
2.5. Andrea ’s *Diving reserves the right to cancel access to the online store for those users who maintain debtor or unpaid balances with Andrea ’s *Diving (Erika *Lopez SLU).
3. METHOD OF PAYMENT, DELIVERY AND WITHDRAWAL OF ORDERS
3.1. PAYMENT.
The payment of the price of the bienesy services purchased and the shipping costs, will be made in accordance with the means of payment that at all times are indicated on the Portal. Currently the available means of payment are:
- Credit card
- Bank transfer
- Count refund
To proceed with the payment, the user must follow each and every one of the instructions indicated, providing the information that, if applicable, is required in the electronic commerce payment gateway. All data provided for this purpose are encrypted to guarantee their security.
3.2. DELIVERY.
The delivery of the orders is made by email in a maximum of *24h .
3.3. TERMS AND CONDITIONS OF CANCELLATION AND REFUND:
In case of cancellation 7 days before the activity, the amount paid will be refunded*
In the event of cancellation more than 48 hours before the start of the activity, the amount paid will not be refunded. However, the activity may be rescheduled at no additional cost within the following three months, provided it is within the same calendar year as the original booking. This does not apply to promotional offers or discounted bookings.
For cancellations made less than 48 hours before the start of the activity, no refund will be issued and the booking cannot be rescheduled.
*In the Diving Courses, the refund of ’100 of payment and signal will not be made in any case, but if the date of the course can be modified without extra charge during the year of this reservation.
The promotions offers that will not be modifiable on the date or will not be paid in case of cancellation.
The refund of the amount paid will be made in the same way as the payment has been made.
Andrea ’s diving (Erika Lopez SLU) reserves the right to cancel the activity for reasons of poor condition of the sea or usafety conditions, and the refund of the amount paid will be made or the possibility of agreeing a new date will be given.
The price of the online theory kit will be the one shown on the SSI website under each course.
⚠️ ATTENTION
If the participant does not meet the medical or legal requirements to carry out the activity, or if decides unilaterally not to continue the course once it has started, or if the course is not successfully completed, no refund of the amount paid will be made.
4. TAXES
4.1. Residents of the European Union. The prices of the products that are on sale and their corresponding shipping costs are applicable to Value Added Tax. (I.V. A.)
4.2. Residents in non-EU countries.
Purchases made by natural or legal persons residing in non-EU countries will be exempt from payment of I.V. A. No orders will be served in Post Office Offices.
For this purchase/send system and due to its tax regime, the geographical areas corresponding to the Canary Islands, Ceuta and Melilla are considered Extra-Community territories.
4.3. Residents in the Canary Islands.
The purchase system is subject to the legislation in force in this Autonomous Community.
5. APPLICABLE LEGISLATION. SUBMISSION TO FUR
5.1. The current contract will be governed by Spanish legislation, which will be applicable in the non-contracted in this contract in terms of interpretation, validity and execution.
5.2. The parties expressly waive the jurisdiction that may correspond to them and expressly submit to the Courts and Tribunals of Girona to resolve any controversy that may arise in the interpretation or execution of these contractual conditions.
